The proposed rule to terminate the program that allows certain H-4 spouses to obtain employment authorization is not expected to be published until at least June 2018. The rule was previously slated for publication in February 2018. The U.S. Department of Homeland Security is apparently in the process of making revisions to the proposal. No further details were provided.

Assuming the proposed rule is eventually published, it will not go into effect immediately. Rather, it will still have to go through the remainder of the formal rule making process, which would likely take at least several months. For the time being, the H-4 EAD program remains in effect, unchanged.

As soon as any new details emerge regarding the fate of the H-4 EAD program, the information will be posted on MurthyDotCom. “Subscribe to the free MurthyBulletin” to have the information delivered to your inbox each week.
